Appellant was convicted of first degree murder in April 1987, and his conviction was affirmed in this court. Smizer v. State,
752 P.2d 406 (Wyo. 1988). On July 14, 1988, appellant filed a petition for post-conviction relief in the district court pursuant to W.S. 7-14-101,
et seq. In addition to the relief asked for in the petition, appellant sought the appointment of counsel to assist him in
handling the matter. The State filed a motion to dismiss and objected to the appointment of counsel. The district court entered
an order dismissing the petition and denying appointment of counsel on September 1, 1988. Appellant filed his notice of appeal
on September 15, 1988, and the appeal was docketed in this court on October 25, 1988.
